Terms of Service

These terms (“Terms”) govern your use of VenuePitch, a subscription software service provided by Kyle Daylan, trading as VenuePitch (“we”, “us”). By creating an account you agree to these Terms. If you don't agree, don't use the service.

1. Who can use VenuePitch

You must be at least 18 and have legal authority to enter this contract (on your own behalf or on behalf of your business). You agree to provide accurate account information and keep it up to date.

2. Your subscription

  • Plans and prices are shown on our pricing page. All prices are in GBP, exclusive of VAT where applicable.
  • Subscriptions renew monthly (or annually if selected) until you cancel.
  • You can cancel at any time from the Stripe customer portal. Cancellation takes effect at the end of your current billing period.
  • 30-day money-back guarantee on your first month. If you're unsatisfied within the first 30 days of your first paid subscription, email us for a full refund. Applies once per customer.
  • We may change prices with 30 days' email notice. Continued use after the change constitutes acceptance.

3. Content and licences

You own your content. Any photos, product images, text, or files you upload remain yours. You grant us a limited licence to store, process, and display that content strictly for the purpose of providing the service to you (including transmitting it to our AI processor Google Gemini for generation).

Generated outputs. AI-generated visualisations are yours to use for your business (client pitches, marketing, portfolios, etc.). We make no copyright claim over generated content. You are responsible for ensuring you have the right to use any input imagery (e.g. product photos you didn't take).

Prohibited content. Do not upload copyrighted material you don't have rights to, images of identifiable people without their consent, or anything unlawful, defamatory, or infringing.

4. Acceptable use

You agree not to:

  • Reverse-engineer, scrape, or attempt to bypass rate limits
  • Resell VenuePitch access to third parties without a licensing agreement
  • Use the service to generate content that impersonates real venues you don't own or represent
  • Upload malware or attempt to disrupt the service
  • Use the service for illegal purposes or in breach of any law

We may suspend or terminate accounts that breach these rules, with or without notice.

5. AI-generated content — important caveats

VenuePitch uses third-party AI models to generate images. These outputs are illustrative previews, not photographic representations. AI-generated imagery may contain visual artefacts, incorrect dimensions, or physically implausible arrangements. You are responsible for reviewing every generated image before sharing it with clients or third parties. VenuePitch is not liable for business decisions made based on AI-generated visualisations.

6. Service availability

We aim for high availability but make no uptime guarantee. The service depends on third-party providers (Supabase, Vercel, Google Gemini, Stripe) which may have outages beyond our control. We are not liable for consequential losses arising from downtime.

7. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of these Terms or your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits, lost bookings, or loss of business reputation.

Nothing in these Terms limits liability for death, personal injury, fraud, or other liabilities that cannot be excluded by law.

8. Termination

You may terminate your account at any time. We may terminate or suspend accounts for breach of these Terms, non-payment, or if we discontinue the service (with 60 days' notice for the latter). On termination, your access ends and we will delete your content within 90 days per our Privacy Policy.

9. Governing law

These Terms are governed by the laws of England and Wales. Any dispute will be resolved exclusively in the courts of England and Wales.

10. Changes

We may update these Terms. Material changes will be emailed with at least 30 days' notice. Your continued use after the effective date constitutes acceptance.
